This web site is operated by Caroline Potter of Caroline Potter Photography (we or us). The web site gives you information about the photographic services that we provide and also provides access to a number of ordering and payment services which may be used in accordance with these terms. These services include photographic sessions, the ability to order prints and other merchandise online and the ability to make payment for ordered services online.
These terms govern the relationship between you and us. Our services, both photographic and via this web site, can only be used if you agree to these terms. You may only our services in accordance with these terms.
You must be eighteen years or over in order to agree to these terms and use our services.
We may vary these terms at any time. If we do so, we will show the varied terms on this web site and they will come into effect immediately that they are shown.
What you are not allowed to do
You may not
- copy (whether by storing on disk, printing on to paper or in any other way whatsoever), distribute (including copies), alter or tamper with any material contained in this web site, save that you may print out one copy of each page you visit, each time you visit, for your own personal use;

- use any images you purchase from us (either as prints or electronically) for commercial purposes;
- remove any copyright, trade mark or other intellectual property notices contained in the original material from any material printed off or copied from this web site or from any other materials you may obtain from us.
What you must do
- where you have been given a password to access certain parts of this web site you must keep that password secure at all times. You will be responsible for any damage caused by unauthorised access resulting from your failure to keep your password secure;
- indemnify us for any action, claim, damages, liability, cost and expense arising out of any use by you or your guests of this web site in breach of these terms;
- ensure that where you have arranged a session with us you are at the agreed venue at the correct time on the agreed date. Where you fail to attend at a previously arranged session we reserve the right to charge you the session fee and any applicable travel fee.
Terms and Conditions
Force majeure
In the event of total photographic failure, for whatever reason, beyond our control the limit of our liability shall be the total refund of all monies paid. Your statutory rights are not affected.
Rights
We retain all intellectual property rights, including copyright, to the images that we take during any session and to any other image or content on this web site. We may use those images for any purpose whatsoever, including promotion, marketing, commercial or other use.
Operation of the web site
We may change the format and content of the web site (or any services or products expressed to be offered on it) at any time. We may terminate or suspend the operation of the web site (or any services or products expressed to be offered on it) for support or maintenance, in order to update content or for any other reason. This can be done at any time and without notice.
Data Protection
Personal data provided to us through this web site will only be used in accordance with our privacy policy. Please read through this carefully before proceeding. By providing your personal data to us you are consenting to its use in accordance with our privacy policy.
Services
Once you have booked any session or placed an order for any goods or services (including any order for prints or other merchandise) the order will not be treated as having been accepted until you receive confirmation from us that this is the case. The decision as to whether to accept any order from you is at our discretion and we are not bound to do so.
Questions or complaints
Complaints or claims must be notified to us within 28 days of receipt of any goods or, in the case of non delivery, within a reasonable time of when the goods were expected to arrive. If you have a question or complaint please contact us.
Law and jurisdiction
These terms (and the provision of any goods and services by us) are governed by and are to be interpreted in accordance with English Law. In the event of any dispute arising in connection with these terms or with the provision of any goods and services by us the English Courts will have exclusive jurisdiction over such dispute.

For the purposes of the Data Protection Act 1988 (the Act) the data controller is Caroline Potter, 3 The Willows, Dymock, GL18 2AY. From time to time we may use data processors, who are not employees, agents or otherwise connected with us (Data Processors).
